In this post, I want to discuss another item at the scene: a cordless telephone.____________________________________________________Case SummaryIn July of 2002, the body of Nikki LaDue January was found seated on the balcony of her condominium in Pass Christian, Mississippi. Officers stated that she had a single gun shot wound to her right temple area.A Sterling .380 caliber pistol was partially under her left thigh on a chair, her right leg was propped up against the table in front of her, and a cordless phone on the table was covered in blood. There were two different brands of cigarettes and two different lighters on the table in front of her.A bullet was located in a chair on the next balcony, and a shell casing was later found by a maintenance man in the condo's pool.Ms. January had apparently been deceased for several hours, and her five-year old son was found in the residence unharmed.Authorities at the scene quickly classified the death as a suicide. --------------------------------------B) The TelephoneNear the end of Pass Christian Police Department detective Tom Pustay's investigative narrative, a report where he describes the death scene of Ms. LaDue January, he makes the following curious statement:"...There is a cordless phone on a table that is covered with blood. It is unknown how it got there or how the blood got on it..."As the report continues, a reader expects the detective, who has introduces a seemingly out of place bloody phone, to clarify that initial statement.He does not. Strangely, no additional information about the phone is included in Pustay's report, but he photographed it (shown below).Blood Covered White Phone (Photo Credit)The family allowed me to review a second police report on the case--that of one of the police first responders that morning: Sgt. Willie Davis.Sgt. Davis' description of the scene does not mention the bloody phone on the table.So, two detailed reports of a death scene thought to be a suicide, and an object that was evidently covered in blood and lying on a table about five feet from the body, is barely mentioned.But, why is the phone important?Remember, the pathologist hired by the family to examine Nikki's body stated that death occurred "immediately or very rapidly after immediate loss of consciousness."So, a bloody phone on a table would have been either placed there by the woman immediately as she was dying or, and here we go again, moved there by someone else. Now, the phone was evidently moved once by Nikki's husband, Phil January.According to documents provided by Nikki's family, Phil stated that he initially saw the phone"in the middle of her lap." Mr. January evidently added that the phone was covered in blood (as in the photo), not near Nikki's hand, and was in an area of her lap that had no blood stains.In addition, the family states that Phil was also confused by the source of the blood on the phone, spoke with Detective Pustay about it, and was concerned over the investigator's dismissal of the detail. When authorities arrived it was said that the phone's battery was dead.In sum, a woman's death is declared a suicide. The gun believed to be used in the death is found in a chair partially under one of the victim's legs. A portable phone covered in blood, is seen on a table in front of the woman--but it is unknown how the blood got there.It is reasonable to argue that the gun was moved and later placed between the victim's legs.The telephone was moved at least once before the body was photographed--and it is likely that the item was relocated twice prior to police arriving.That said, this renders more questions than anything:--How did the phone get covered in blood?--Was she holding the phone at the time of death?--Who moved it (how many times) and why?This "open-and-shut suicide" case appears to be anything but that.I'll have more next Monday--including another strange item photographed on Ms. LaDue January's table, but not mentioned in police reports.----------------------------------------All posts on this topic can be viewed by clicking here: Nikki LaDue January.

The vase points to the spot Billy is buried in the Naugatuck Valley. In the best of circumstances it would take a master craftsman to cobble that broken vase back together, but what if the glass is left on the floor for weeks, for months, for seven years? She is pictured here between Congressman Chris Murphy (D-CT) and Congressman Ted Poe (R-Texas) who co-sponsored "Billy's Law". The case is a white-hot political football. For two years the only agency investigating Billy’s disappearance was the Waterbury Police Department who mangled leads, lost evidence and had the nerve to suggest that 18 months after he was murdered that “Billy was probably having a beer in Europe, and would come home when he was ready”. Furious with the Waterbury investigation, the Smolinskis successfully lobbied the FBI to get involved, and in August 2006 the Feds seized control of the case. While technically assisting Waterbury, the FBI probed into the hornets nest in Seymour, Shelton and Woodbridge to uncover information that triggered searches beneath driveways in Shelton in 2007, and a massive excavation of a farm meadow on Bungay Road in Seymour in 2008. A Freedom Of Information request in April 2007 revealed a sharp disconnect between the Waterbury PD and the FBI. Information released by the Waterbury PD documented a Crime Stoppers tip detailing who murdered Billy and where he was buried. The two Waterbury detectives who handled the tip had followed up by driving through the neighborhood Billy was alleged to be buried in, and filing a report. That information, according to Mike Ward, a private investigator working with the Smolinski family, was not shared with federal investigators. That tip eventually led to a search in Shelton on May 7th, 2007, with FBI, Waterbury, Shelton and Connecticut State Police participating. Cadaver dogs were used and a small hole was dug alongside a house on Fort Hill Road. A police spokesperson told Channel 3 News that the search was called off at 3 p.m. on May 7th, and would resume the following day. On May 8th nothing happened. And four years later no police have returned to the area to further plumb the Crime Stoppers lead. The Crime Stoppers tip had singled out Hubbell Lane in Shelton, and the police search focused on Fort Hill Ave and Edgewood Ave in Shelton. Private investigator Mike Ward, a former New Milford police officer, believes the search may have missed the mark. “Has anyone pulled all the permits in Shelton to see who was pouring concrete at that time?” Ward asked. “Maple Ave is one street over from Hubbell Lane and there were footings (the base of a foundation) for a house that passed inspection on September 2. Do the math. It doesn’t take Einstein to figure this out. No one has ever looked into Maple Avenue.” Ward, who now lives in Kentucky, spent hundreds of hours investigating the case. When the FBI got involved Ward said he shared all his information with FBI agent Bill Aldenberg, and was immediately shut out of the case.An overhead view of the massive dig for Billy Smolinski on Bungay Road in Seymour in August 2008. “Every place I went after that I was told that the FBI had advised people not to talk with me,” Ward said. “Very quickly I was chasing my own tail.” In 2008 Ward backed off the case. “ I thought the FBI would follow up and figure out what happened to Billy. I was wrong. The FBI dropped the ball.” And five years after it seized control of the investigation, the FBI has meekly pulled back. “We still talk occasionally with the FBI,” Janice Smolinski said, “but they are no longer actively working the case.” Instead, the investigation has transitioned into the hands of the Connecticut State Police, with on-going efforts by Detective Ron Goodmaster of the Seymour Police Department, and Detective Ben Trabka of the Shelton Police Department. The State Police have sent divers down to investigate a quarry, followed up on a lead in Oxford, and appear to the Smolinskis to be working the case. But not all leads are followed up on, and when they aren’t, the Smolinskis are working with private investigator Todd Lovejoy, a former Waterbury detective, and with volunteer cadaver dogs from Farmington and Canada, to explore the woods themselves. “Some of the leads are lightly followed up on and then the tip is cleared,” Janice Smolinski said. “We are not satisfied.”Todd Lovejoy reads the VIN # off an abandoned car during a search for Billy Smolinski two years ago. Consider a tip called into the FBI earlier this Spring. After watching an hour-long special on Discovery ID, a woman in Shelton called to report that she had seen a white truck and a small red car driving up a steep embankment in the woods behind her house in late August of 2004. Billy drove a white truck and a suspect in the case died of a drug overdose in the Autumn of 2004 in a small red car. The FBI passed the tip off to Shelton Detective Ben Trabka who called the woman one week later and arranged a time to check out the lead. The woman took a day off from work to meet with Trabka at 11 a.m., but the detective called at the last second and said he had another case, and would come at 2 p.m. He never showed up. The woman called and left him a follow-up message and said she was still willing to speak with him, but Trabka never called her back. Frustrated, she reached out to Todd Lovejoy, whose contact information was on the Discovery ID show and printed on billboards and flyers. Lovejoy met with the woman and found her story compelling and credible. For years she had seen and heard quads tearing through the woods behind her house, but she had never seen a car or truck there. “I was on my back deck grilling when I heard wheels spinning and making a lot of noise,” the woman told the Observer. “It was very odd and I wondered where they were going. I thought it was worth investigating.” So instead of the FBI or the Shelton PD, the investigation was conducted by Lovejoy, Deb Monte and her cadaver dog Murphy, and Jan and Bill Smolinski. Four searches were conducted over two months. A suspicious fire pit was excavated, a chunk of a car bumper was collected, and a shard of bone (later identified as animal) was found. The tip was later shared with the Connecticut State Police.Private investigator Todd Lovejoy, left, and Bill DeFrancesco dig for the remains of Billy Smolinski in the woods in Shelton. “The family should not have to be investigating their own son’s murder because the detective is too busy,” Janice Smolinski said. “That’s crazy.” Shelton is an affluent town of 38,000 residents and is located in Fairfield County. There are 55 sworn police officers and seven detectives. The town website states the “Detective Division is responsible for assisting the Patrol Division in investigating serious crimes. This includes armed robberies, burglaries, vehicle thefts, drug trafficking, computer crimes, identity theft as well as assisting the Traffic Division with the investigation of fatal motor vehicle accidents.” There is no mention of murder on the website because it rarely happens in Shelton. According to crime statistics provided on the internet by the Shelton PD there has been one murder in the past 8 years, which makes Detective Trabka’s sluggish response to the tip in a murder investigation more alarming. I contacted Trabka for an explanation and asked if he were still investigating the disappearance of Billy Smolinski. He said he was working with the Major Crime Unit of the Connecticut State Police, and the Chief State’s Attorney’s Office, and following leads and running down tips. “We’re still very active,” Trabka said. I then brought up the specific tip and asked why he ignored it. “I have other cases to work on too,” Trabka said, When told of the incident, private investigator Mike Ward was audibly agitated. “There are valid leads not being followed up on,” Ward said. “This is just another circle-jerk in Billy’s case.” Besides ignoring the tip, there are rumors that Detective Trabka has a close relationship with Chad Hansen, one of the suspects in the case. Hansen, 31 years old, is now in prison for providing false information to police that triggered the massive dig on Bungay Road in Seymour, and a dig in High Rock State Park in Naugatuck. In the past ten years Hansen has been arrested eleven times on charges ranging from forgery, possession of narcotics, assault, burglary and resisting arrest. Hansen’s arrest in September 2010 for making false statements in the Smolinski case is the second arrest in the seven year investigation, the first being when Janice Smolinski was arrested in Woodbridge for hanging flyers of her missing son on a telephone pole (the charges were later dropped). During the phone interview with Trabka I asked him what he could tell me about Chad Hansen. Trabka said “his name has come up as maybe having something to do with Billy Smolinski.” Trabka confirmed that it was Hansen who led authorities to the farm in Seymour, and he confirmed that Hansen was now in prison for providing false information. I then asked Trabka if he had a personal friendship with Chad Hansen, or the Hansen family. He said “No, I have a law-enforcement relationship. Rumor and innuendo are the nature of the beast in this business.” Trabka said much of the information in the case has come from self-serving stories from prison where the informant was told something by someone, who heard it from someone else. “There is a lot of spin, and versions of an incident that is very difficult to track down,” Trabka said. “We waste a lot of time trying to prove or disprove these prison tales.” The Connecticut State Police have been to Shelton twice to follow-up on the lead about the truck and car driving deep into the woods in August 2004. Every department, police officer and private investigator has collected pieces of the broken vase, but until they are all collected in one place the puzzle may never be solved. The answer, and perhaps the only way to glue the vase back together, is with a federal grand jury. A federal grand jury has the power to subpoena the sordid characters in this deadly game and squeeze them to talk. A grand jury can call in the various police agencies and collect the pieces of glass they refuse to share with other investigators. “I believe a federal grand jury is the only way we are going to find our answers,” Janice Smolinski said. “We’ve been asking for one for the past two years.” The request for a federal grand jury was denied at the end of July, but Bill and Janice Smolinski are not giving up. “There is a murderer out there,” Janice Smolinski said. “The public isn’t safe, and it’s time to bring our son home. We need a federal grand jury. We need help.” ( A vigil for Billy Smolinski Jr. will be held August 21st at 6 p.m. on the Green in downtown Naugatuck. I did not know her in life but came to know her through her incredible big loving family. One Saturday morning an old woman came to my door, she was carrying the obituary of her granddaughter. She told me the little girl’s name was Becca and she had been the victim of sexual abuse by her stepfather Bob L. Ingle (a police officer.) She said little Becca had been so brave to come forward told about the abuse, testified to a Grand Jury twice but then tragically lost her life in a car crash that January. Becca’s death had stalled the rape case but it was also what motivated the family into action. Becca’s Death would not be in vain. Her family would not be denied justice. Becca’ father Aden McEvoy, a police officer, had always wanted Becca to be free from all that she had gone through and to see that no other children would ever suffer at Ingle’s hands ever again. Becca’s family held prayer vigils, made a website, DVD’s, T-shirts, petitions and protested on the courthouse steps. When delay after delay in Becca’s case made them question whether there would ever be justice for Becca? There was much local TV, newspaper and Internet coverage, which produced information on two additional alleged rape victims of Ingle’s. They also came forward and spoke to the investigators. The defense tried every trick in the book to get this case dismissed. There were delays, gag orders and appeals made to the Alabama Supreme Court. Robin Sax describes it best in her blog post entitled, “Why Does a Child Molester Get to Benefit from the System He Disgraced?” There was even a scandal, not related to the case, where the DA abruptly resigned. Which meant they had to begin all over again with a new Assistant District. Many wondered if this family would ever have peace or know justice? Yet they stayed strong and they never gave up hope. You see their faith was in God not in the justice system. Finally after being delayed at least six times over the past three years the rape trial date came. Becca’s little girlfriend (whom she had confided in) testified along with her big sister Nina. Nina said Becca, at age 10, had a secret to tell her, but she didn’t want to say a bad word. So she wrote on a piece of paper the word “SEX”. What a terrible burden for such a little child. What a horrible trauma she had endured. The Dr who examined Becca testified about sexual abrasions and produced medical documents. The Dr had asked Becca to write down who had done this to her. In her school girl handwriting Becca wrote “Bob L. Ingle.” The DA projected this slip of paper onto the wall, Becca McEvoy knew her molester, he was her stepfather, he was a police officer and the name on his badge read “Bob L. Ingle.”I wonder if he might have worn that badge when he molested her. I wonder how many other children did this monster harm? It took the jury just 90 minutes to find him guilty. Thank you God", said Becca’s sister Nina Tucker. Bob Ingle had not spent one day in jail since his arrest. The family was told they were not to show any emotion inside of the courtroom or there would be consequences. The guilty verdict meant he could now spend the rest of his life in prison. Susan Murphy-Milano writes on the verdict in her post entitled “Justice Prevailed.” Imagine their surprise when they heard Bob Ingle wasn’t going to jail to await his sentencing! Rebecca's family wanted Ingle behind bars. The judge instead decided to allow him to stay out of jail on bond with conditions. Ingle's sentencing was set for Februrary 25th, almost one month away. It was earlier rumored Ingle would appeal. He had remained emotionless during the trial possessing an almost superior attitude. Did he think he was going to get away with it? The day of Ingle’s sentencing came with a bang; Ingle chose death over prison. He was found at home with two handguns at his side around 2:30pm. I remember when I heard the news “Rebecca’s Rapist Kills Himself”. I suspect this was God’s justice for Becca. Ingle’s criminal rights had always trumped Becca’s victim’s rights. Or so it seemed, until the afternoon of Feb 25th. Becca’s family said, “Now Becca has eternal justice.” A weight had been lifted off their shoulders. No more court dates, no more appeals, no more reliving the horror of what little Becca had endured. Becca’s Momma (Reesa Taylor) breathed a sigh of relief, she had been afraid of Ingle. Now her little girl was safe and her family could begin to heal. In the end I can’t help but think of Becca, in heaven, looking down on her big beloved family. She was a hero, so small yet so brave. 7/29/2002 Official Police Form is reportedly not completed - the offense is labeled within moments "Suicide". Officer Davis says wound “appears” to be a bullet hole.
The weapon is reportedly labeled a "Pistol" - no make, model or caliber listed, evidence collected is said to be a 9mm casing can not be fired from the .380. Coroner Hagrove allegedly said the bullet was a metal jacket, but husband Phil allegedly said his gun was loaded with plain lead bullets. None has been seen by family or PI.
There is no mention of the gun found - believed to belong to husband Phil January (Nikki was found sitting on it - it was under her right thigh, in an awkward, almost phallic position, shown in blurry polariod, later obtained by families PI) Phil supposedly told police the gun was on table.
There is no indication of any reported testing being done by police, no autopsy, no toxicology report, no x-rays, no fingerprints of gun or bloody phone or apt, no metal or paraffin tests at the time of Nikki's death. Det Pustay later states in letter there was a metal test ...which no one has a copy of.
All physical evidence is reportedly gone, clothing, bloody phone, bullet, casing, gun, computer, cigarette packs and lighters. Pustay allegedly remarks - “not needed in a suicide.”
Husband Phil January reportedly asks how many rounds were left in his gun? Good question right? Why wasn't the gun tested and the bullet and casing compared to those rounds left in the gun's chamber. What about fingerprints on gun, phone, lighters? How can they explain that Nikki shot her self and then turn the gun around and sat on it? Why is most of the blood reportedly on the ground and not on Nikki or splattered on the wall?
Husband Phil, a self described ex-police officer, removed the bloody phone from Nikki's hand, when he finds her dead body on balcony. Why did he allegedly admit to moving evidence?
The family reportedly requested an independent autopsy in NY. This the only autopsy done and is found to be inconclusive. It's also reported the family's PI requested supporting evidence from police to be sent to Pathologist with intent to prove suicide or other manner of death. Pathologist reportedly only receives blurred polariod photos, no hard evidence (supposedly disposed of by law enforcement). Toxicology tests reportedly indicate the presence of cocaine and amphetamines but don't show levels. Why?
According to anonymous sources there was no questioning, of the 5 yr old son, by police. Why wouldn't Nikki leave her son at sitters instead of having him stay all night with her dead body? What mother would do that to her beloved child? In the above simulated 911 call why does her supposed BF Nancy Burge call her this girl instead of my dearest friend Nikki? Neither does she go to the funeral although it's reported she had a paid RT ticket. What does she fear?
It is reported Mike, father of son Zack, had a confrontation with husband Phil about his being taken to Louisiana. Was anyone else upset about Nikki or son Zack leaving? Where had Nikki gone between 9 pm (after she left Eric H.) and 11 pm when she picked up her son at the sitters?
Lead Det Tom Pustay was arrested and convicted of pedophilia. Pustay a 21 yr veteran of Pass Christian Police Dept resigned from force, Does this not bring question’s of Officer Pustays character and credibility as a criminal investigator. Why isn't this case being looked at by AG Office or FBI?
