Prosecutor Laurie Lacelle outlined a complex conspiracy: “The evidence is that Shafia, Tooba and Hamed had decided that there was a diseased limb on their family tree. The Montreal mother accused in the deaths of her three daughters and her husband's first wife told a Kingston, Ont., courtroom Wednesday that photos of one of the girls in revealing clothing was not a dishonour to her. "[Sahar] was young, it doesn't matter if she took those pictures at that time," Tooba Yahya testified, adding that all teenagers take such images. Yahya is charged with first-degree murder in the deaths of her daughters Zainab, 19, Sahar, 17, and Geeti Shafia, 13, as well as her co-accused husband Mohammad Shafia's first wife Rona Amir, 52. The couple's eldest son Hamed, 21, is also charged with murder. The Crown contends the females were victims of so-called honour killings. The accused have pleaded not guilty. "If they took naked pictures, it wasn't a dishonour," Yahya said earlier Wednesday to a packed courtroom on her third day of testimony. The Crown grilled Yahya on specific details relating to the discovery of racy photos of her daughters. She appeared tired and a number of spectators left the courtroom towards the end of the day. At one point, Yahya said she could not remember the date of the funeral for her three daughters. The photos, which depicted her two oldest daughters with their boyfriends and wearing lingerie, have been central to the case. Tooba Mohammad Yahya filled the courtroom with her cries for minutes at a time as lawyers reviewed evidence in the killings of her daughters.
Two of three people accused of killing their family members have admitted there is enough evidence to go to trial. Mohammad Shafia, 56, did not, meaning the Crown must prove it has enough evidence to put him on trial. The preliminary inquiry was initially scheduled to start Feb. 2, but was held Friday as a surprise to ensure the trial isn't moved to another city.
The accused appear briefly in a courtroom, only to hear that a new date, Dec. 4, has been set to continue their focus hearing with the judge.
Lawyer Peter Kemp, representing Mohammad Shafia, informed Jack Chiang, a justice of the peace, that the entire month of February has been set aside for a preliminary inquiry in the case.
The accused appear in court via a live video feed. Defense lawyers ask that the case be remanded for two weeks to give them time to study the evidence presented to them by Kingston police. The evidence was so extensive the police presented it on a computer hard drive rather than hand in several boxes of printed documents.
The accused couple appear briefly via video at a Kingston courthouse with one request: that they be allowed to speak to their three surviving children without lawyers present.
A lawyer representing Hamed Mohammad Shafia said his client was attacked in a Napanee, Ont., prison, according to a CBC News report.
Mohammad Shafia, 58, his second wife Tooba Mohammad Yahya, 42, and their son Hamed, 21, are arrested and charged with four counts each of first-degree murder. They all plead not guilty.
Police planted a recording device in the Shafia vehicle to capture conversations between the surviving family members. “God’s curse on them — May the devil shit on their graves,” Shafia was recorded as saying.
Shafia showed up at Kingston police headquarters to report that his Sentra was missing, along with three of his daughters and Rona Amir Mohammad, who he described to police as his cousin.
Three sisters — Zainab, 19, Sahar, 17, and Geeti, 13 — and Rona Amir Mohammad, 52, the second wife of Mohammad Shafia, were found dead in a black Nissan Sentra at the bottom of the Rideau Canal at Kingston Mills. On the same day, Shafia reported to police that his car was missing, along with three of his daughters and Mohammad, who he described as his cousin.
