In a 1987 memo, Kagan wrote she was "not sympathetic" to a petitioner's claim that his constitutional rights were violated by Washington, DC's gun ban. The Supreme Court struck down that ban in a nearly identical case in 2008.

March 25th, 2010, WASHINGTON — The Senate on Wednesday killed a proposal by Sen. Tom Coburn to prevent convicted sex offenders from getting Viagra or similar prescriptions in the insurance markets to be established under the new health reform law. Coburn's amendment was one of several shot down by Democrats working to approve a package of changes to the health care reform bill signed into law Tuesday by President Barack Obama.
Healthcare Bill Exempts Congress And Staff This is so outrageous Im fairly speechless. The Congressional Research Service believes a court could rule that the legislation would exclude professional committee staff, joint committee staff, some shared staff, as well as potentially those staff employed by leadership offices. However, when the combined Senate bill came to the floor, the definition of staff had been narrowed. Both senators filed a second amendment in December restating their original intent, but they say Democrats blocked it. The American people will be appalled to learn the health care bill exempts leadership and committee staff. This special deal for unelected staff underscores everything the public detests about the arrogance of power in Washington, Coburn said. I tried to fix this inequity along with senators Grassley, Burr and Vitter, but Majority Leader [Harry] Reid obstructed our effort. Due to the far reaching intrusive nature of the Obamacare bill, there are all sorts of things we're now paying for that probably aren't in the public interests. One of those things is we're giving impotent child molesters medicine for erectile disfunction. Sen. Tom Coburn offered an amendment to the reconciliation bill that would correct this issue, and all but 2 Democrats voted to kill the amendment (voted for free boner pills for child molesters and convicted rapists). You read that correctly, the Democrats were nearly united in their defense of the right of rapists and child molesters to free viagra. I'm sure we're never been prouder (certainly not completely embarrassed) of our Senior senator.

Tom Coburn has introduced a few amendments that will be very hard for Democrats to vote against, including no Viagra for sex offenders. Coburns amendments No Erectile Dysfunction Drugs To Sex Offenders This amendment would enact recommendations from the Government Accountability Office to stop fraudulent payments for prescription drugs prescribed by dead providers or, to dead patients. This amendment also prohibits coverage of Viagra and other ED medications to convicted child molesters, rapists, and sex offenders, and prohibits coverage of abortion drugs.
