Criminal Charges Will Be Filed In Balloon Boy Hoax Says Sheriff Jim Alderden - Oct 17, 2009 - FORT COLLINS, Colo. Authorities are pursuing criminal charges in the case of a boy who vanished into his parents' garage while the world feared he was trapped aboard a helium balloon — prompting speculation of a hoax. The boy's parents, Richard and Mayumi Heene, met with Larimer County investigators for much of the afternoon, but Sheriff Jim Alderden didn't say who would be charged or what the charges would be. Alderden didn't call Thursday's hours-long drama a hoax, but he expressed disappointment that he couldn't level more serious charges in the incident, which sent police and the military scrambling to save young Falcon Heene as millions of worried television viewers watched. "We were looking at Class 3 misdemeanor, which hardly seems serious enough given the circumstances," Alderden said. "We are talking to the district attorney, federal officials to see if perhaps there aren't additional federal charges that are appropriate in this circumstance." Suspicion that the balloon saga was a publicity stunt arose almost immediately after Falcon was found in the garage rafters, hiding in a cardboard box. Richard Heene, a storm chaser and inventor whose family has appeared on the reality show "Wife Swap," and his wife had said one of the boy's older brothers had said Falcon was aboard the homemade balloon when it took off. Alderden initially said there was no reason to believe the incident was a hoax. Authorities questioned the Heenes again after Falcon turned to his dad during a CNN interview Thursday night and said "you said we did this for a show" when asked why he didn't come out of his hiding place. Falcon got sick during two separate TV interviews Friday when asked again why he hid. Alderden said Saturday that deputies were seeking a search warrant for the family's home, and there would be more information at a news conference Sunday. After the sheriff went inside, Richard Heene and his wife walked out. As reporters yelled questions, all Heene said was, "I was talking to the sheriff's department just now." He then walked to his car with his wife and a friend, and they drove away. It wasn't clear where the family was late Saturday night. By 9 pm, an AP reporter at the family home said the couple hadn't returned after leaving the sheriff's office. Their three sons were believed to have been at home being watched by sheriff's officials earlier in the day, but their whereabouts also weren't known to reporters in the evening.

During a live interview on Larry King Live on CNN Thursday night, Falcon Heene, of Fort Collins, said he had heard his family calling his name. "You did?" the boy's mother, Mayumi Heene, asked "Why didn't you come out?" Richard Heene then said on national television. Falcon answered, "You had said that we did this for a show." When Richard Heene was pressed by fill-in host Wolf Blitzer to explain what his son meant, he became uncomfortable, finally saying he was "appalled" by the questions. He added that Falcon likely was referring to all the media coverage. When pressed by reporters outside his home after the CNN interview, Heene reacted angrily. "'Let me interrupt this real quick because I can see the direction you guys are heading on this," Richard Heene said. "We weren't even going to do this interview. I'm appalled after all the feelings I went through that you guys are trying to suggest something else." Mayumi Heene added, "All I know is, it was real. I really thought we might have lost him." On Friday, Richard Heene again lambasted speculation that the ordeal was a hoax. "I went through such a roller coaster of emotions (Thursday), to have people say that, I think, is extremely pathetic," he told abc's "Good Morning America." "I'm not selling anything. This is what we do all the time." On Friday, Falcon got sick twice on national television when he and his father were asked during separate TV interviews what he meant about his comment that "we did this for a show." Larimer County Sheriff Jim Alderden said Friday his investigators believe there was no hoax, but investigators will seek a new interview with the family after the CNN broadcast to clarify the statement. "Certainly, that statement that was made last night on the interview raises the questions again," Alderden said. "We do intend to go back and try and reinterview the family." Alderden said an expert told them the helium balloon was capable of lifting the boy into the air. "We did contact a professor at CSU with the expertise to determine the payload and lift (of the balloon) and he informed us that a balloon of that size would handle a payload of 80 pounds. The boy weighed 37 pounds, so it remains conceivable that a boy of that size could have been in the balloon. "We were convinced (Thursday) after talking to parents and having investigators on scene during the duration of event, that the parents were being honest. Their verbal, body language and emotions cwere onsistent with events taking place, believing their child was in the aircraft. Our people didn't think this was being faked." He said that once Falcon came out of hiding, the parents allowed investigators to question Falcon alone, and they did not appear to have anything to hide. However, after seeing the CNN interview, Alderden wanted to know why Falcon said, "We did this for the show." "If it turns out to be a hoax we will seek restitution by whatever means possible," Alderden said. He also said his office had contacted child protective services and asked them not to contact the family until his investigators had a chance to interview them again. He said he hoped to talk to them Saturday. Alderden could not estimate how much it cost to search for the boy but said they were "soft costs" -- costs in manpower and personnel overtime. The cost to fly the two helicopters from the Colorado National Guard, alone, was $14500. Volunteers who helped searche for the boy said they didn't feel it was a waste of time or resources and that it was the best ending anyone could hope for. Maj. Justin Smith, with the Larimer County Sheriff's Office, said there have been no previous calls to the home and no previous indication of problems at the home. "There's nothing throughout and certainly nothing in the end that would indicate there would be any grounds for criminal charges," Smith said.

Alderden said the department "searched the house three times... except for the place where the boy was hiding... There's no ladders to get up in the attic." Due to debris in the garage, they thought it would be impossible for the child to be in the attic. The Sheriff also confirmed that a tip of there being a box in the attic was "erroneous information," confirming a "clear attic space that was flat." Speaking on behalf of investigators, Alderden says: "We were convinced yesterday after talking to the parents and having investigators on scene... that the parents were being honest with us." He added that the family's emotions were "consistent with the events that were taking place." Alderden also commented on the infamous Wolf Blitzer interview the family did later that day. "Clearly that has raised everybody's level of skepticism," he says. He added that investigators planned to "go back to the family and attempt to reinterview them to establish whether this is in fact a hoax." He said such an interview would be conducted later this weekend, as the family is very "fatigued" today. "Certainly people are free to speculate... but those of us in the law enforcement profession have to operate on facts... and not on whay the public might think without any proof." During the start of the question period, the Sheriff confirmed tha the boy's father, Richard, had first called the FAA after the balloon launch, and then a local TV station, before calling 911. Alderden also told a reporter that he finds it "inconceivable" that Falcon would be told to stay in the attic and be quiet for a prolonged period of time. "I just don't see that happening as hyperactive as he is," he said.
